Terms of Service

Last updated: May 25, 2026 · Document version: 2

1. General provisions

These Terms of Service govern the use of the website available at flowmind.technology and related subdomains (together, the "Service").

The owner and operator of the Service is:

FlowMind Technology Sp. z o.o., Pl. Jana Pawła II 19 lok. 48, 50-136 Wrocław, NIP: 8971967134, REGON: 543996884, KRS: 0001223592

Contact: kontakt@flowmind.technology.

By using the Service, you acknowledge that you have read and accept these Terms. If you do not agree with any provision, please do not use the Service.

These Terms apply to use of the informational website. Agreements for the provision of services or delivery of FlowMind APS (Advanced Planning and Scheduling) software are entered into separately — outside the Service — on terms individually agreed with the Controller.

2. Definitions

  • Controller — the entity identified in Section 1 of these Terms.
  • Service — the FlowMind website together with its subpages, forms, and online tools.
  • User — any person who visits the Service or uses its features.
  • FlowMind APS — the advanced production planning and scheduling system offered by the Controller.
  • Form — the contact form or any other form available on the Service.

3. Scope and nature of the Service

The Service is informational and marketing in nature. It enables you to, among other things:

  • learn about the features and applications of FlowMind APS software;
  • use the ROI calculator (estimated savings calculations);
  • submit an inquiry via the contact form;
  • manage cookie preferences.

Content published on the Service — including feature descriptions, case studies, articles, and marketing materials — is provided for information only and does not constitute a commercial offer within the meaning of the Polish Civil Code, unless expressly stated otherwise.

The Controller does not conduct online sales through the Service. Purchase, implementation, or licensing of FlowMind APS requires separate arrangements with the Controller.

4. Technical conditions of use

Using the Service requires a device with Internet access and an up-to-date web browser. Some features (e.g. forms with Google reCAPTCHA, analytics) require JavaScript to be enabled and, for optional cookies, consent given in the cookie panel.

The Controller makes reasonable efforts to keep the Service running properly but does not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond the Controller's control.

5. Rules for using the Service

The User agrees to use the Service in a manner that is:

  • compliant with applicable law and these Terms;
  • not disruptive to the operation of the Service or the Controller's infrastructure;
  • respectful of third-party rights, including intellectual property and personality rights.

In particular, the following is prohibited:

  • automated content scraping in a way that burdens the Service or bypasses its security measures;
  • sending spam, false, or misleading submissions through forms;
  • attempting unauthorized access to the Controller's systems;
  • distributing unlawful, vulgar, discriminatory content or content that infringes personality rights through the Service.

The Controller may temporarily or permanently restrict access to the Service or reject a form submission in the event of a breach of these Terms or suspected abuse (e.g. exceeding submission limits, bot detection).

6. Contact forms

The contact form is intended for commercial inquiries, consultation requests, or other correspondence with the Controller.

By submitting the form, the User confirms that the data provided is accurate and relates to them or the entity they represent. Providing data is voluntary but necessary to handle the inquiry.

Submitting the form does not create a contract or guarantee a response within a specific timeframe. The Controller responds within a reasonable time, typically on business days.

The rules for processing personal data submitted through forms are described in the Privacy policy.

7. ROI calculator

The ROI calculator available on the Service is intended solely for indicative estimates of potential savings resulting from implementing FlowMind APS. Results depend on data entered by the User and on the assumptions of the calculation model.

Calculator results do not constitute a guarantee of specific economic outcomes, a commercial offer, or investment or tax advice. Final implementation parameters and benefits are determined individually with the Controller.

8. Intellectual property

All elements of the Service — including text, graphics, logos, page layouts, software screenshots, video materials, and source code — are protected by copyright and industrial property rights of the Controller or third parties from whom the Controller holds a license.

The User may view Service content and use it only within the scope of permitted personal use. Copying, modifying, distributing, or commercial use of Service content without prior written consent from the Controller is prohibited, unless applicable law provides otherwise.

The name "FlowMind", the logo, and related APS software designations are reserved by the Controller or its partners.

9. External links

The Service may contain links to third-party websites (e.g. Google documentation, social media profiles). The Controller is not responsible for the content or privacy policies of those sites. Use of them is at the User's own risk.

10. Cookies

The Service uses cookies and localStorage in accordance with the Privacy policy. Cookie preferences can be changed at any time via the "Cookie settings" link in the Service footer.

11. Liability

The Controller provides the Service "as is", to the fullest extent permitted by law. The Controller is not liable for damages resulting from:

  • use of the Service in a manner inconsistent with these Terms or applicable law;
  • decisions made based on informational content or ROI calculator results;
  • Service downtime, technical errors, or data loss caused by factors beyond the Controller's control;
  • actions of third parties, including hosting, analytics, or email service providers.

The above provisions do not exclude or limit the Controller's liability towards consumers to the extent that such exclusion or limitation is impermissible under mandatory applicable law.

12. Complaints and contact

The User may report issues regarding the operation of the Service or breaches of these Terms to: kontakt@flowmind.technology.

A complaint should include a description of the problem and, where possible, information enabling identification of the submission (e.g. the email address used in the form). The Controller reviews complaints within 14 business days of receipt.

13. Changes to the Terms

The Controller may amend these Terms for important reasons (e.g. changes to Service features, legal requirements). A new version will be published on this page together with the update date.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. In the event of material changes, the Controller may additionally inform Users through a visible notice on the Service.

14. Final provisions

Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code and the Act on Provision of Electronic Services — to the extent applicable to use of the Service.

Disputes between the Controller and a User who is a consumer will be resolved by a court with jurisdiction under the rules on court jurisdiction. A User who is a consumer may use out-of-court complaint and claims procedures, including the EU ODR platform: ec.europa.eu/consumers/odr.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.
